Limitation of Liability

Client/Customer agrees to indemnify, defend and hold harmless B-MIT, LLC from and against any Damages (hereinafter defined), to the extent suffered or incurred as a result of a breach of the terms contained herein, or the negligent or intentional acts of the indemnifying party. A party’s liability to the other party under the Agreement will be limited to Damages. “Damages” includes claims, demands, fines and penalties (whether civil or criminal), liabilities, expenses, and costs (including reasonable fees and disbursements of legal counsel and accountants), actually suffered or incurred by a person in connection with the Services.
